Administration of Justice Bills of Interest

Bail Reform Legislation

AB 42 (Bonta) – Bail: Pre-Trial Release
As Amended March 27, 2017 – Concerns

Assembly Bill 42 by Assembly Member Rob Bonta would require counties to establish a pretrial services agency that would be responsible for gathering information about newly arrested persons, conduct pretrial risk assessments, prepare individually tailored recommendations to the court regarding release options and conditions, and provide pretrial services and supervision to persons on pretrial release. While AB 42 is a mandate – there is no funding currently in the measure. AB 42 passed out of the Assembly Public Safety Committee with a vote of 4-2 and has been referred to the Assembly Appropriations Committee.

SB 10 (Hertzberg) – Bail: Pre-Trial Release

Senate Bill 10 by Senator Bob Hertzberg would require counties to establish a pretrial services agency that would be responsible for gathering information about newly arrested persons, conduct pretrial risk assessments, prepare individually tailored recommendations to the court regarding release options and conditions, and provide pretrial services and supervision to persons on pretrial release. While SB 10 is a mandate – there is no funding currently in the measure.SB 10 passed out of the Senate Public Safety Committee with a vote of 5-1 and has been referred to the Senate Appropriations Committee.

These measures are a collaborative effort between Assembly Member Bonta and Senator Hertzberg to reform the current bail system.
