Bail: Attorney Fees: Forfeited Bail

Cost Recovery for Bail Forfeitures                

AB 1854 would restore the ability for prosecutorial agencies and county counsel offices to recover their costs incurred in successfully opposing a motion to vacate the forfeiture of bail. AB 1854 passed out of the Assembly Public Safety Committee (7-0) and is now on the Assembly Floor.

Cities and Counties: Legal Services: Contingency Fee Contracts

AB 2804 (Brown) – Oppose

RFP Requirement for outside counsel

AB 2804 creates barriers for counties to enter into contingency fee contracts with outside counsel by imposing new request for proposal (RFP) requirements. Counties turn to this type of contract when they need specialized legal counsel to address complex or time intensive matters in the public interest, such as public nuisance abatement cases. CSAC has joined with UCC, RCRC, and CSAC-EIA in opposing AB 2804. AB 2804 is awaiting hearing in the Assembly Local Government Committee.

Construction Contracts: Indemnity

SB 885 (Wolk) – Oppose
As introduced February 19, 2016         

SB 885 would prohibit contracts that require state licensed design professionals, including engineers, land surveyors, architects, and landscape architects, to defend claims made against other persons or entities involved in construction projects. SB 885 is awaiting hearing in the Senate Judiciary Committee.
