Commission on Catastrophic Wildfire Cost and Recovery Adopts Final Report

On June 7, the Commission on Catastrophic Wildfire Cost and Recovery adopted its final reports to be sent to the Governor and Legislature. The five member Commission separated into three 2-person working groups to produce three separate reports on the topics of homeowners insurance and mitigation, creating a wildfire fund, and utility liability. The Commission’s reports included the suggestion to change the current strict liability standard of inverse condemnation to a fault based standard for utilities. Several Commissioners came to the Legislature to testify in front of both the Senate and Assembly to discuss suggestions in the reports, both before and after the final adoption.
Prior to the Commission’s final adoption of its reports, the Governor and Legislative leaders issued a joint statement expressing that changes to utility liability law would not be considered for the remainder of the Legislative session. CSAC and our coalition partners also issued a joint statement in opposition to the commission’s proposed changes to inverse condemnation.
