CFRA Regulations Moving Along
The California Fair Employment and Housing Council last month
approved revised regulations to the California Family Rights Act
(CFRA), the state law administered by the Department of Fair
Employment and Housing that works in tandem with the federal
Family Medical Leave Act (FMLA) to secure certain leave rights
The revised regulations are intended to clarify several of the existing regulations concerning, among other things, timelines for responding to employee requests for CFRA leave, clarification of reinstatement, and the interplay of CFRA and California Pregnancy Disability Leave. Additionally, the revised regulations clarify that same-sex spouses are covered and adopts recent amendments to the federal FMLA regulations to ensure FMLA and CFRA are consistent.
The regulations now head to the Office of Administrative Law with an expected promulgation time of July 2015. You can read the revised regulations here.
