AB 1934 would create a program that would offer incentives to
commercial developers who include affordable housing as part of a
mixed use project or in partnership with an off-site developer in
the same jurisdiction. CSAC removed its concerns and took a
neutral position because amendments to the bill more clearly
define the process and clarify that incentives offered to a
commercial developer must be “mutually agreed upon by the
developer and the jurisdiction.” This language is important in
that what works in one community may not work in another. CSAC
also suggested that the program be initiated as a pilot project
and be reassessed by the Legislature after three years.
