The California Health and Human Services Agency (CalHHS) recently
created an updated
Public Charge Guide (also available in
Spanish) to assist individuals and families with
understanding federal public charge policy. The CalHHS resource
details which public benefits can be considered when determining
whether to extend or revise a legal immigrant’s status, who the
public charge rule applies to, and which public benefits are not
considered. This updated guide reflects the recent final
public charge rule issued by the Biden Administration earlier
this month. As detailed in a recent
federal update in the CSAC Bulletin, this final rule
overturns the Trump Administration’s rule to expand the
definition of public charge to require consideration of receipt
of additional public benefits.
