Mariposa County v. CalHR (C101902)

This case addresses the ramifications of the California Department of Human Resources both finding that an employee is likely to continue his sexually harassing behavior and ordering the county to reinstate the employee. CSAC’s brief, which was prepared by Allison Pierce and Jennifer Takehana in the Tulare County Counsel’s Office, emphasizes the liability concerns with returning such an employee to work and the untenable and legally compromised position it creates for county employers that use CalHR for employee discipline.
