IHSS Statewide Collective Bargaining Legislation Advances with Significant Improvements

On Wednesday, the Senate Labor, Public Employment and Retirement Committee approved AB 283 by Assembly Member Matt Haney. The measure would transition collective bargaining for the In-Home Supportive Services (IHSS) program from counties to the state and is sponsored by the IHSS provider unions (SEIU and UDW). CSAC, the County Welfare Directors Association (CWDA), and the California Association of Public Authorities (CAPA) negotiated with the author and sponsors over the past several months and reached agreement on a series of amendments that address county concerns. The June 12 version of the bill includes several of these amendments outlined below:

  • Remove several items from the scope of representation that are core county public authority administrative functions, including provider registry, backup provider system, and provider recruitment and retention.
  • Add county and public authority representatives to the IHSS Statewide Bargaining Advisory Committee.
  • Require consultation with county and public authority Advisory Committee members about programmatic and fiscal implications prior to finalizing a memorandum of understanding.
  • Clarify that the bill does not change any other aspect of the IHSS employment relationship.

Two additional amendments have been agreed to and will be incorporated in a subsequent committee. These amendments clarify that counties would not be responsible for the increased costs that the state agrees to in statewide bargaining, including wage and benefit increases and new program requirements. Based on these amendments, CSAC and CWDA now have a “Support if Amended” position, and CAPA has gone neutral on AB 283. The linked letter contains further details on the forthcoming amendments.

CSAC’s engagement on this bill continues our efforts on the overall IHSS statewide collective bargaining issue, which included participation in a stakeholder group led by the California Department of Social Services.
