Governor Newsom Proclaims End to 26 States of Emergency

On Tuesday, January 31, Governor Newsom signed a proclamation terminating 26 open states of emergency dating back to 2017. These include various fires, prior storms and other incidents including the mpox (formerly referred to as monkeypox) emergency proclaimed in August of last year, coinciding with the termination of the federal public health emergency on mpox.

Biden Administration Announces End of Federal Public Health Emergency on May 11

On January 30, the Biden Administration communicated to Congress its intent to extend both the COVID-19 national emergency and public health emergency (PHE) declarations to May 11, and then end both emergencies on that date. This wind-down would align with the Administration’s previous commitments to provide at least 60 days’ notice prior to termination of the PHE.

Federal Public Health Emergency Extended

On January 11, U.S. Health and Human Services Secretary Becerra extended the federal public health emergency (PHE) due to the COVID-19 pandemic for another 90 days, delaying the expiration until April 11, 2023, although the Secretary may terminate the declaration whenever he determines that the emergency has ceased to exist. Secretary Becerra has previously promised to provide 60 days’ notice before ending the emergency.

The California Governor’s Office of Emergency Services (Cal OES) is requesting local jurisdictions to submit all eligible COVID-19 costs incurred up to July 1, 2022 in order to maximize Federal Emergency Management Agency (FEMA) reimbursement. Although the September 30 deadline for this submission to Cal OES has lapsed, Cal OES is still accepting these submissions as many local jurisdictions’ submissions are still outstanding.

Legislation Agreement on the Medical Injury Compensation Reform Act

California’s Medical Injury Compensation Reform Act (MICRA) was established to allow for the recovery of all economic damages or out-of-pocket costs for medical expenses. In past years, there has been a push to amend this act. Most recently trial lawyers collected signatures for an anti-MICRA ballot measure which would allow for significant increases in the dollar amounts sought by plaintiffs in suits against medical providers and healthcare professionals.

The legislative vehicle to implement the Governor’s Community Assistance, Recovery, and Empowerment (CARE) Court proposal, SB 1338 by Senators Tom Umberg and Susan Talamantes Eggman, passed two Senate policy committees this week. Next stop: the Senate Appropriations Committee.

Counties raised concerns primarily regarding the lack of funding for new county responsibilities as well as issues related to the bill’s language on county sanctions, housing, and who would be eligible for the CARE Court program.

CSAC Executive Director Graham Knaus appointed Farrah McDaid Ting as the Association’s Director of Public Affairs and Member Services this month.

Farrah began her career at CSAC more than 20 years ago, first serving under former Director David Liebler on the public affairs side, and then moving to the legislative team as an analyst in 2005. Since 2007, Farrah has focused on county health and human services, and currently serves as the Association’s Senior Legislative Representative for Health and Behavioral Health.
