CSAC Submits Comments to State Water Board On New Waters of the State Regulations

The State Water Resources Control Board is proposing significant changes to California’s protected waters of the state rule, including changes to the definition of wetlands and its’ dredge and fill procedures. The Board originally proposed to take action on the proposed rules in early March, but recently pushed back taking action by a month. The Board will now hold a public workshop on March 5, 2019 and will consider taking official action on the proposed changes April 2, 2019.

CSAC has been working closely with CEAC to monitor the rulemaking and recently sent a comment letter to the State Water Board regarding the Board’s proposed changes to waters of the state, wetland definition, and dredge and fill procedures. The letter can be found here.

On February 22, the Board released updated text of the rule which can be found here. Water Board staff also prepared a list of potential policy choices for the Board to make within the new definition. That list can be found here.
