CSAC has filed an amicus brief in this case, which poses a very important question for counties: Whether the State can condition receipt of discretionary State funding on waiver of constitutional rights and protections. The case involves a challenge to a statute requiring charter cities to implement the Prevailing Wage Law in order to receive State construction funding, despite a Supreme Court decision concluding that charter cities do not have to follow the Prevailing Wage Law because of the authority granted to them in the constitution. While counties are not impacted by the Prevailing Wage Law issue, the general principle of allowing the State to circumvent constitutional protections by conditioning State funding is an important one for counties.
