It would prohibit a county or city that had a redevelopment area from forming a Sustainable Communities Investment Authority pursuant to the bill until all of the former redevelopment agency’s debts are fully paid.

The Department of Finance has asked the Commission on State Mandates to revisit a claim related to the Sexually Violent Predators program, which the Commission first found to be a mandate in 1998. The Department claims that the passage of Proposition 83 (Jessica’s Law, 2006) eliminated the state’s liability for the mandate.

Currently, the great majority of Vehicle License Fee revenues fund 1991 Realignment and 2011 Realignment, with a small portion paying for DMV and FTB (Franchise Tax Board) administrative costs.

Vetoed

Earlier this week, Governor Brown vetoed SBX1 8. This bill would have modified the provisions of the budget that eliminated redevelopment agencies unless they provided more money for schools and other interests.

The Governor in his veto message said he thought it unwise to modify legislation that was currently pending review by the Supreme Court. The Court has said it will rule on the redevelopment lawsuits by January 15.

As part of this year’s budget, the Legislature suspended essentially all mandates that the Commission has deemed reimbursable over the years. In fact, most reimbursable mandates have already been suspended for years, some since as long ago as 1991. The current list of suspended mandates now numbers 61, while only 13 mandates received funding.
