AB 1948 (Mullin) – Concerns

AB 1948, by Assembly Member Kevin Mullin, would impose minimum training/education requirements for those elected or appointed to the office of County Treasurer/Tax Collector. Under current law, county Board of Supervisors can adopt minimum standards for the position of County Treasurer/Tax Collector, both appointed and elected. Many Boards of Supervisors have exercised this authority while some have not.

The bill has been approved by the Senate and Assembly and now awaits the Governor’s decision.

SB 628 by Senator Jim Beall was amended late in the session to provide for a new economic development tool, Enhanced Infrastructure Financing Districts (EIFDs). Counties will recall that the Governor had proposed the concept of EIFDs in his January budget proposal and May Revision, building on the existing infrastructure financing statutes. IFDs, like redevelopment agencies (RDAs), are economic development financing mechanisms that rely on tax increment financing.

CSAC has had a long-standing oppose position on SB 1129, Senator Darrell Steinberg’s measure that seeks to make changes to three components of the dissolution process: enforceable obligations, long range property management plans and compensation agreements, and use of bond proceeds for debt issued in 2011. Recent amendments to the bill include new deadlines for the State Controller’s Office to complete audits of asset transfers by former redevelopment agencies, as well as audits of asset transfers by successor agencies.

Special elections have embarrassingly low voter turnout. The 2013 special elections were particularly poor in turnout, with turnout rates in single digits in some of the later elections.

As Amended on June 18, 2014

AB 280, by Assembly Member Luis Alejo, would implement a state-level preclearance system similar to the federal system effectively overturned by the US Supreme Court last year. The new state-level system would apply to about 25 counties and many more school districts, cities, and special districts for which counties run elections. A jurisdiction would be subject to the new rules if the voting-age citizen population of at least two racial, ethnic, or language groups is at least 20 percent.

AB 2493, by Assembly Member Richard Bloom, would authorize successor agencies of dissolved redevelopment agencies to use and commit bond proceeds for those bonds issued between January 1, 2011 and June 28, 3011 for certain types of projects. This would directly affect the allocation of property tax revenues, since the allocation of property tax revenues is a zero-sum game. AB 2493 would therefore have negative fiscal consequences for affected taxing entities, including counties.

Tuesday’s statewide primary election yielded some interesting results: perhaps record low voter turnout, a new influx of campaign cash in the form of independent expenditures for state legislative races, and some real nail-biter results, with a number of races around the state too close to call. Perhaps the least surprising news of the night: Proposition 42 passed handily.

The Assembly passed AB 1717 71-2. The bill now moves to the Senate.

State Revenues Well Above Projections

 The state’s revenues continue to outperform estimates, with October’s revenues over ten percent higher than expected. For the year-to-date, general fund receipts are up 2.5 percent.

 The main state-level revenue of importance to counties is the sales tax because it directly funds both 1991 and 2011 Realignment as well as Proposition 172. Over the first four months of the year, sales tax receipts have come in 2.8 percent higher than budget estimates.

I spent my childhood in the Central San Joaquin Valley where summers are hot. Not quite California desert hot, but it wasn’t unusual to have days-long stretches of 100-plus degree temperatures. Luckily, my parents had a pool and we did not hesitate to use it. In fact, we spent most of our summer days in swimsuits and, occasionally, sunscreen. My dad also spent a good amount of time maintaining that pool, dripping liquids into a plastic doodad to test the chemicals in the pool water. Then he swished in some chlorine, maybe, and brushed and skimmed.
