The new pricing system, according to CalPERS staff analysis, is an improvement from the current system, achieving greater marketability, premium stability, and administrative ease.

State Revenues Continue to Impress

Five months into the current fiscal year, preliminary state revenues are $1.943 billion, or 4.5 percent, above the 2018-19 Budget Act forecast. California Supreme Court Poised to Decide on Vested Pension Rights

The California Supreme Court heard oral argument last week on a controversial case dealing with pension benefits for government workers. The case, Cal Fire Local 2881 v. California Public Employees’ Retirement System (CalPERS), challenges a provision in the Public Employees’ Pension Reform Act (PEPRA) that eliminated the option for employees to purchase service credits (also known as “airtime”). This issue is highly significant for local agencies since it could potentially affect future pension liabilities and collective bargaining agreements.

New Taxing Authority Exercised on Online Sales

The California Department of Tax and Fee Administration (CDTFA) recently issued a new ruling, effective April 1, 2019, that will require out-of-state retailers selling above certain thresholds to collect use taxes, or sales tax based on where a good is used, including locally levied use taxes. Currently, consumers are responsible for paying the use tax on merchandise from out-of-state retailers. Under the new ruling, CDTFA is shifting the responsibility for remitting the use tax from the consumer to the retailer, consistent with the authority granted in the South Dakota v.

Assembly Budget Chair Phil Ting (D-San Francisco) outlined key priorities for the 2019-20 State Budget in his “Blueprint for a Responsible Budget” earlier this week. Under the theme of “Funding Progress | Protecting Tomorrow,” the blueprint provides a high-level overview of how to further bolster reserves, keep promises made, and pursue long-term goals given the LAO’s estimated $15 billion in unanticipated revenue for 2019-20.

The CSAC Government Finance and Administration (GFA) Policy Committee met last week in San Diego County and discussed a wide range of important issues on the horizon for 2019. Funding Opportunity for County Census Activity to be Released Next Week

Counties will receive notice on November 9 about the potential funding from the State in support of outreach activities related to the 2020 U.S. Census (Census). A letter addressed to the County Administrative Officer will include information about the potential award amount, steps for accepting the allocation, timelines, and other contracting parameters.  Counties should be aware they will have 90-days to pass a Board Resolution agreeing to the terms of the funding if they choose to accept the award.

The Legislature and California Department of Tax and Fee Administration (CDTFA) are ramping up efforts to collect sales and use tax from out-of-state online retailers, following the U.S. Supreme Court’s decision in Wayfair v. Preliminary General Fund agency cash for the first three months of the fiscal year reached a new height of $28.542 billion which is $1.032 billion higher than 2018-19 Budget Act estimates. Latest figures for the month of September show most of the big revenue sources surpassing budget estimates, except for sales and use tax which fell $31 million short.

Property Tax Initiative on “Split Roll” Qualifies for 2020 Ballot

An initiative to scale back Proposition 13 protections for commercial and industrial properties is now eligible for the November 2020 ballot. Specifically, the initiative seeks to assess commercial and industrial properties at fair market value while leaving homeowners’ Proposition 13 protections in place, a concept known as “split roll.”

Improvements Made to Online Debt Reporting System

State Revenues Dip Below Budget Estimates

With total state revenues missing Budget Act estimates for July by $178 million (or 2.4 percent ), Fiscal Year 2018-19 is unfortunately off to a lackluster start. As shown on the latest Department of Finance (DOF) cash flow report, $480 million in unrealized sales and use tax is the primary reason for the shortfall. However, DOF maintains this could be due to receipts expected in July being shifted into August.

Update on Mandate Debt Repayment

There’s good news for counties awaiting the mandate repayment provided in the 2018-19 State Budget. According to the State Controllers’ Office, program payments were mailed on Friday, July 27. This does not include interest, which will be mailed separately. No specific time frame was given for the interest payments, just before the statutory deadline of November 1, 2018.

November 1 Due Date for State Mandate Repayment

The 2018 Budget Act included mandate repayment for counties associated with the cost of providing “AB 3632” services for seriously emotionally disturbed children. The approximate $280 million for counties statewide includes actual program costs and interest owed for the mandated programs that used to be provided by counties, but has been provided by schools since 2012.

State Ends Fiscal Year Above Budget Expectations

Department of Finance (DOF) reports a total of $136 billion in general fund cash for 2017-18. That’s $1.5 billion higher than the 2018 Budget Act forecast. June alone brought in $1.6 billion of unanticipated revenue, mainly in personal income and corporation taxes representative of second quarter returns. These results offset disappointing sales tax revenues, which fell behind fiscal year budget estimates by $380 million, or 1.5%.
