Several Counties Adopt New Cannabis Tax Ordinances

Voters overwhelmingly approved several new cannabis measures in cities and counties up and down the state this week. Six county tax measures were approved by wide margins in Imperial, Mono, San Benito, San Luis Obispo, Santa Barbara and Yolo counties. This new group joins an increasing number of jurisdictions across the state that have decided to regulate and tax commercial cannabis activity. The measures vary in their rates and structure and reflect the diversity of local commercial cannabis regulatory programs that cities and counties are adopting.

The Senate and Assembly Budget Committees have released their proposed changes to the Governor’s Cap & Trade Expenditure Plan with some proposed changes that could impact counties. The original Cap & Trade Expenditure plan for FY 18-19 was released by the Governor in January and totaled $1.25 billion allocations to various programs.

CSAC Advocates for Debris Removal Local Cost Share Waivers

CSAC has requested funds from the Administration and Legislature to waive the county match cost requirement for debris removal for the Southern California counties impacted by Governor’s declared disasters from the 2017 fires and 2018 mudslides. This waiver was included in the Governor’s May Revision of the budget for Northern California counties, but not Southern California counties.

Cannabis Agencies Extend Emergency Regs for 180 Days

The three licensing agencies responsible for California’s cannabis regulation announced that they will readopt the current emergency cannabis regulations for another 180 days. The emergency regulations originally became effective on December 7last year. The three licensing agencies include the Bureau of Cannabis Control, the California Department of Public Health and the California Department of Food Agriculture.

The Bureau of Cannabis Control (BCC) will hold the fourth meeting of the state Cannabis Advisory Committee on May 17 in Oakland, Alameda County. The Committee will review recommendations from the final three subcommittees on regulations relating to licensing applications, manufacturers, and micro businesses. The Committee will also consider suggested recommendations that would require statutory changes.

CalRecycle is hosting a final round of informal stakeholder workshops to review draft regulatory language and discuss the implementation process for SB 1383 regulations. The bill, signed in 2016, establishes methane emissions reduction targets in a statewide effort to reduce short-lived climate pollutants in various sectors of California’s economy. The final formal rulemaking is likely to take place in late summer this year.

Monterey, SLO First to Join Cannabis JPA

The Monterey County Board of Supervisors joined San Luis Obispo County in adopting a Joint Powers Agreement to join the California Cannabis Authority, a Joint Powers Authority of county government backed by CSAC and the CSAC Finance Corporation. The California Cannabis Authority (CCA) will develop and manage a statewide data platform that will gather, collect, and analyze information from a myriad of data sources into one resource.

Cal Recycle will host two informal workshops, in Northern California and Southern California to continue discussions about new regulations that require significant reductions in landfill waste. The regulations from SB 1383 require a 50 percent reduction in organic waste sent to landfills statewide by 2020 and a 75 percent reduction by 2025. The benchmark for comparison is the 2014 level.

The California Bureau of Cannabis Control began accepting license applications on Friday, December 8 and will begin verifying local permits and ordinances with each local jurisdiction’s designated point of contact. This point of contact was collected through a recent survey. Once the Bureau receives an application from an applicant in your county, they will be sending a letter to verify the local permit submitted to them.

Cannabis Working Group to Discuss Emergency Regulations

CSAC’s Cannabis Working Group will host a call on Friday, December 22 at 10 AM to discuss the recently released emergency regulations from the Bureau of Cannabis Control, California Department of Food and Agriculture, and California Department of Public Health.

CSAC is a co-signatory of comment letters to each of the lead licensing agencies in conjunction with the Rural County Representatives and Urban Counties of California. The state is expected to begin issuing licenses in January 2018 through these newly released emergency regulations.

CSAC Weighs In on State Landfill Regulations

CSAC is working closely with CalRecycle as it develops new regulations related to greenhouse gasses produced in landfills. Last year the legislature adopted SB 1383 which implements a strategic plan to decrease short-lived climate pollutants including soot, hydrofluorocarbons, and methane from California’s air. A major element of the law is decreasing the amount of methane produced in California’s landfills.
