The Board of State and Community Corrections (BSCC) is seeking
people interested in participating in a subcommittee of the
Juvenile Regulations Revision Executive Steering Committee (ESC)
Subcommittee on Secure Youth Treatment Facilities (SYTF)
Regulations.
Recently, Governor Gavin Newsom increased efforts statewide to
tackle organized retail theft ahead of the holiday shopping
season. The California Highway Patrol (CHP) Organized Retail
Crime Task Force (ORCTF) is increasing their presence at shopping
centers throughout the state and working with local law
enforcement agencies to make arrests and heighten
visibility.
CSAC recently reported on the final outcomes of measures that
were approved by the Legislature and delivered to Governor Newsom
for action. To keep counties informed of new laws of interest and
impact, CSAC will publish a series of articles to spotlight those
laws in each policy area. This week, the Administration of
Justice policy area provides information on new laws affecting
courts, mental health diversion, probation, corrections, justice
involved youth and elections.
The new laws listed below become effective January 1, 2023 unless
otherwise noted.
The Board of State and Community Corrections (BSCC) is announcing
the release of the Public Defense Pilot Program (PDPP) Request
for Applications (RFA).
This RFA makes approximately $49.4 million available to counties.
PDPP funds must be utilized for indigent defense providers,
including public defenders, alternate defenders, and other
qualifying entities that provide indigent defense in criminal
matters for the purposes of workload associated with Sections
1172.1, 1172.6, 1473.7, and 3051 of the Penal Code.
The Board of State and Community Corrections (BSCC) is announcing
the release of the Proposition 64 Public Health and Safety (Prop
64 PH&S) Grant Program Cohort 3, Request for Proposals (RFP).
The Prop 64 PH&S Grant Program directs revenue from the
cultivation and sale of cannabis to projects that promote public
health and safety.
The Office of the State Public Defender (OSPD)
will be hosting a webinar on either Friday, November 4,
2022 or Monday, November 7, 2022 to provide information
and answer any questions about how counties can use Byrne JAG
funding to support indigent defense. Please let us know if
you are interested and whether Friday or Monday works
best. The specific time is TBD.
The Board of State and Community Corrections (BSCC) is seeking
members to serve on a new Executive Steering Committee (ESC) for
the
Mobile Probation Service Centers Grant Program. Statements of
Interest for this ESC will be taken until a full membership has
been reached.
The National Association of Counties (NACo) is pleased to
announce the Opioid Solutions Leadership Network: a learning and
leadership-building community of county leaders pursuing
innovative and evidence-based solutions to the opioid epidemic.
The Opioid Solutions Leadership Network will identify and convene
county leaders from across the country who are leading efforts to
invest opioid settlement funds in strategies that save lives,
address the needs of people with substance use disorders and
prevent future harms.
The California Health Facilities Financing Authority (CHFFA) is
pleased to invite California counties to submit applications for
its third funding round for the Community Services Infrastructure
Grant Program (CSI Grant Program), which creates and expands
community alternatives to incarceration in the form of mental
health treatment, substance use disorder treatment and
trauma-centered services.
Late last week, the BSCC Board awarded more than $171 million in
two grants: the Adult Reentry Grant and the California Violence
Intervention and Prevention Grant.
At its September 20 business meeting, the Judicial Council will
consider a proposal on how to allocate $10.3 million
included in this year’s state budget to backfill the loss of fee
revenue to trial courts due to the repeal of civil assessment
fees authorized by Assembly Bill 177.
Ongoing state funding for court technology has expanded
voice-to-text translation in clerks and self-help offices,
electronic filing, hearing reminders, access to court records,
and other technology services.
California’s legislative session came to a close in the early
morning hours this week with hundreds of bills now awaiting
action by Governor Gavin Newsom. The following provides an update
on major bills of interest for the Administration of Justice
policy area. CSAC staff will continue to monitor and advocate for
County priorities during the signing period, which ends
September 30, 2022.
The Board of State and Community Corrections Board will meet on
Thursday, September 8 at 10:00 am. The meeting
will be held in person at their office located at 2590 Venture
Oaks Way, Sacramento and virtually via zoom.
Earlier this month, the U.S. Department of Justice Office of
Justice Programs Bureau of Justice Assistance (BJA) opened its FY
2021 State Criminal Alien Assistance Program (SCAAP)
solicitation.
AB 1744 (Levine) Probation and mandatory supervision: flash
incarceration. - Support
Assembly Bill 1744 by Assembly Member Marc Levine would extend
the use of flash incarceration by county probation departments
until January 1, 2028. Existing law authorizes probation and
mandatory supervision, which in each case is a period of time
when a person is released from incarceration and is subject to
specified conditions and supervision by county probation
authorities.
The National Association of Counties (NACo) will hold the second
part of their
Jail Reentry for People with Substance Use Disorders webinar
series, Creating a Continuum of Care on Wednesday, March 16
from 11:00 am – 12:00 pm. During the webinar, presenters will
discuss strategies counties can use to partner with
community-based providers to ensure seamless connections to care
when people are released from jail.
The Council on Criminal Justice and Behavioral Health (CCJBH)
recently released their 20th Annual Legislative
Report.
As required by Penal Code Section 6044 (h) (1), CCJBH must report
the Council’s activities during the preceding year, to include
recommendations for improving the cost-effectiveness of
behavioral health and criminal justice programs.

Late last week, the Board of State and Community Corrections
(BSCC) gave notice of the proposed regulatory action(s) described
in this public notice. It is the intent of the BSCC to
amend regulations contained in Title 15, Division 1, Chapter 1,
Subchapter 4, California Code of Regulations, which is commonly
known as the Minimum Standards for Local Detention Facilities,
after considering all comments, objections, and recommendations
regarding these regulations.
Late last week, the Board of State and Community Corrections
(BSCC) Board voted to release two Requests for Proposals for more
than $200 million in grants aimed at reducing recidivism and
helping people transition back to the community after
incarceration.
The Council on Criminal Justice and Behavioral Health (CCJBH)
will host their Juvenile Justice Workgroup meeting on
Friday, February 11, 2022 from 1:00 – 3:00
p.m.
During the Juvenile Justice Workgroup meeting, the CCJBH will
provide an update on the Juvenile Justice Compendium and Toolkit.
Additionally, the Office of Youth and Community
Restoration will provide an update on its progress,
including background, organizational structure and the vision for
the future.
The Judicial Council and the State Controller’s Office recently
announced the availability of their annual Revenue Distribution
WebEx training session, offered to address impacts of newly
enacted legislation to trial court revenue distributions and
provide updates on other related areas of interest. Registration
is not required.
Led by Supervisor, Zach Friend, the Criminal Justice Council of Santa
Cruz County (CJC) conducted one, if not the first in the
nation, report providing a comparative snapshot of key policies
and procedures established by county law enforcement agencies.
The purpose of the report was to highlight consistencies between
the local law enforcement agencies in Santa Cruz County and where
there are opportunities to improve.
